Acuerdo para la creación de un reglamento que regulará la intermediación inmobiliaria

El Ministerio de Vivienda y el Consejo Rector de los Colegios Oficiales de los Agentes de la Propiedad Inmobiliaria (APIs) al completo mantuvieron ayer una reunión en la que trataron, entre otros asuntos, el reglamento que regulará en un futuro la intermediación inmobiliaria, liberalizada desde 2000 por el Gobierno del PP.
Durante la reunión, la ministra de Vivienda, María Antonia Trujillo, explicó que su Gabinete ya está trabajando en la futura normativa que regulará el ejercicio de la intermediación inmobiliaria e hizo especial hincapié en la formación de los actores del sector.
El presidente de los APIs, Santiago Baena, aseguró que entre ambas partes hay un ‘acuerdo total’ sobre la necesidad de regular la intermediación y, por ello, de empezar ‘desde ya’ a dar forma al reglamento.
El punto de partida de esta normativa será la propuesta realizada por los APIs en la que se establece, entre otras condiciones, la creación de un registro público donde habrán de inscribirse los intermediarios, la prohibición del ejercicio a aquellas personas con antecedentes penales y la obligación de contar con una oficina abierta al público.
No obstante, una de las propuestas más concretas de los agentes de la propiedad es la necesidad de suscribir un seguro de responsabilidad civil de hasta 600.000 euros. Según Baena, cada agente de la propiedad inmobiliaria ya cuenta con este tipo de seguro que puede llegar a cubrir los 700.000 euros por cada siniestro.
Por el momento, el Ministerio de Vivienda y el Consejo General de Colegios Oficiales de Agentes de la Propiedad Inmobiliaria prevén mantener una nueva reunión en las próximas semanas.
La intermediación inmobiliaria fue liberalizada en el año 2000, durante el Gobierno del PP, como mecanismo para introducir mayor competencia en el mercado y reducir así el precio de la vivienda, de forma que, actualmente, la profesión no se encuentra sometida a ninguna exigencia normativa específica.
Actualmente, los APIS son los únicos profesionales de la intermediación titulados y sujetos a unas normas concretas, si bien, están pendientes de la aprobación de un estatuto que actualmente se encuentra sometido a estudio en el Consejo de Estado a la espera de dictamen.
No obstante, María Antonia Trujillo analizó con los agentes de la propiedad los puntos principales del estatuto de forma que, según Baena, podría publicarse en el BOE ‘en breve’.
